These Terms of Service ("Terms") govern your access to and use of Motorscrape, including the website at motorscrape.com and related services (collectively, the "Service"), operated by Motorscrape ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Description of the Service

Motorscrape provides tools to search and aggregate publicly available vehicle listing information from third-party dealership and dealer-related websites. Inventory availability, pricing, and vehicle details originate from those third parties and may be incomplete, delayed, or inaccurate. The Service is for informational purposes only and does not constitute an offer to sell any vehicle.

Eligibility and accounts

You must be able to form a binding contract in your jurisdiction to use the Service. If you create an account, you are responsible for safeguarding your credentials and for all activity under your account. You agree to provide accurate information and to keep it updated.

Acceptable use

You agree not to:

• Use the Service in violation of applicable law or third-party rights
• Attempt to gain unauthorized access to the Service, other users' accounts, or our systems
• Probe, scan, or test the vulnerability of the Service without our prior written consent
• Use automated means (including bots or scrapers) to access the Service in a way that overloads, disrupts, or circumvents rate limits, authentication, or technical controls
• Reverse engineer, decompile, or disassemble any part of the Service except where prohibited by law
• Use the Service to build a competing product or to redistribute bulk data obtained through the Service without permission

Intellectual property

The Service, including its software, design, branding, and documentation, is owned by Motorscrape or its licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial use unless we agree otherwise in writing.

Third-party content and links

The Service may display or link to third-party websites, listings, and advertisements. We do not control and are not responsible for third-party content, policies, or practices. Your dealings with third parties are solely between you and them.

Paid features and billing

Certain features may require payment through our third-party payment processor (for example, Stripe). Fees, renewal, and cancellation terms are presented at checkout and in any applicable order summary. You authorize us and our payment partners to charge your selected payment method. Taxes may apply where required by law.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT RESULTS WILL MEET YOUR EXPECTATIONS.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOTORSCRAPE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US$100), EXCEPT WHERE PROHIBITED BY LAW.

Indemnity

You will defend, indemnify, and hold harmless Motorscrape and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any third-party right.

Suspension and termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or harms the Service or other users. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and indemnity) will survive.

Changes

We may modify these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

Governing law

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law principles, except where preempted by applicable law in your jurisdiction. Courts located in Delaware will have exclusive jurisdiction over disputes arising from these Terms or the Service, unless applicable law requires otherwise.
